Thank you for your interest - By commissioning me, you agree to the following Terms of Service. Please read carefully!I (Zefyrine) retain the right to make changes to these terms of service should the need arise.
I. Communicationi. All communication takes place via Twitter/X DMs or VGen messages. Returning clients may request communications via Discord.ii. Response time: I strive to respond to all inquiries within 24 hours. Should I - due to unforeseen circumstances - not answer within 48 hours, feel free to message again. Should I be unavailable for longer periods of time due to foreseen circumstances, I will attempt to inform my clients beforehand.iii. Updates: Once work on your commission has begun, I will regularly update you on the progress and may reach out for clarification or approval during the process.
II. Workflow/Revisionsi. Process: After the initial agreement on the commission details, I will start with creating an initial, rough sketch. Once approved, this will be followed up by a refined sketch, base colours, and rendering.ii. Revisions: During each sketch phase (rough and refined), clients are entitled to two major revisions. Once the refined sketch is approved, a reasonable amount of minor revisions is still possible. Major changed beyond this point may incur additional fees.iii. Final Approval: Once the artwork is completed, I will send it for final approval. Once final approval has been given, revisions of any sort will incur an additional fee.
III. Deadlines and Disclosurei. Rush-Fees: Rush fee payment equals +50% of the total commission price and only one rushed commission slot is available at a time and lets your commission skip to the front of the curent work queue. I will strive to complete your commission as fast as I am able to.ii. Non Disclosure Agreement (NDA): If you should want for your commission not to be posted about on my social media channels of choice, the NDA fee of +50% of the total commission price will be added. If your reason for choosing this service is a pending VTuber debut, please do inform me about the debut date so I know when to post the art.
IV. Paymenti. Payment Method: Payment can be made via either, Paypal or Ko-Fi. If the commissioning platform is VGen, the payment will be made through VGen.ii. Payment Plans: All payment will be made up front. A 50/50 or 25/25/25/25 payment plan can be discussed. However, please acknowledge that if opting for a payment plan, work will only commence in accordance with the total amount paid. (E.g. If only half of the total amount owed has been paid, only half the work will be done and shared.)
V. Refund Policyi. Cancellation: I only offer full refunds in the case that work on your commission has not yet started.ii. Interruption: If work has already commenced on your commission, a partial refund will be discussed on a case by case basis, depending on how far along the progress is.iii. Completed Works: Once the commission is completed, no refunds will be given.iv. Chargebacks: In case of unauthorised chargebacks, I may revoke the client's right to use the work in any way and the client will be blacklisted.
VI. Usagei. Personal Use: You are permitted to use the commissioned artwork for personal use, including displaying it online.ii. Commercial Use: If you intend to use the artwork for commercial purposes, a separate agreement must be discussed prior to commissioning. Commercial use includes usage for content creation/streaming/VTuber purposes. Commercial use commissions are priced at 150% of the original commission price.iii. Commercial Use (Extended): If you intend to use the artwork for extended commercial purposes, a separate agreement must be discussed prior to commissioning. Extended commercial use includes the production and selling of digital and physical merchandise. Extended commercial use commissions are priced at 200% of the original commission price.iv. Credit: When using or displaying my work, credit must be given.v. Alterations: Clients may not alter, reproduce, or sell the artwork without my permission unless otherwise agreed upon.
VII. Intellectual Property Rightsi. Artist's Rights: I retain full rights to the artwork created, including the right to use it for promotional purposes and portfolio display.ii. Copyright: The artwork remains my intellectual property. You are purchasing a license to use the image under the agreed-upon terms.iii. AI and NFT: Under no circumstances is the client allowed to use my work within any AI tools. Under no circumstances is my work to be used as NFTs.
VIII. Acknowledgementi. By placing a commission request, you acknowledge that you have read, understood, and agree to abide by these Terms of Service. Failure to abide by these terms will have you placed on a blacklist.

Thank you for your interest - By purchasing an adoptable, you agree to the following Terms of Service. Please read carefully!I (Zefyrine) retain the right to make changes to these terms of service should the need arise.
I. Usagei. Personal Use: You are permitted to use the adoptable for personal use, including usage as an OC or displaying it online.ii. Commercial Use: If you intend to use the adopt for commercial purposes, notice must be given and the appropriate amount must be paid. Commercial use includes usage for content creation/streaming/VTuber purposes.iii. Commercial Use (Extended): Extended commercial use includes standard commercial usage and the production and selling of digital and physical merchandise.
Extended commercial usage must always be discussed first.
II. Permitted Changesi. The buyer may make changes to the design or commission someone to make changes in their stead, as long as the original concept is still distinguishable.ii. These changes may not be made by editing my art, new artwork must be created to showcase those changes.iii. Purchasing an adoptable character just for the outfit is permitted, however the price remains the same. Equally, giving new outfits to a purchased character is also allowed.
III. Creditingi. When showcasing the adoptable design by posting the original art I made, credit must always be given.ii. If the character is purchased for personal usage, credit is welcome but not required.iii. If the character is used commercially (explained in section I.), permanent credit must be given - e.g. by adding my name to the users bio or a carrd, or by adding my name to singular posts. Just meeting one of these requirements is satisfactory.
IV. Payments, Refunds and Holdsi. Payment for adoptables is to be made entirely, before the design may be used. 50/50 payment plans may be discussed.ii. Purchases are final, no refunds may be given.iii. Chargebacks: In case of unauthorised chargebacks, I may revoke the buyer's right to use the design in any way and the buyer will be blacklisted.
V. Trading and Sellingi. The buyer may freely choose to resell the purchased design, however they are not allowed to do so for a profit. The resale value cannot exceed the price the design was originally purchased for. (Excemption: If the sale includes additional art. If this is the case, please message me first.)ii. The design may be gifted to someone else. However it will lose its monetary value from that point forward and can no longer be sold for any value and may instead only be gifted to someone else free of charge.
VI. Intellectual Property Rightsi. Artist's Rights: I retain full rights to the artwork created for the design, including the right to use it for promotional purposes and portfolio display.ii.
